Terms & Withdrawal

General Terms and Conditions (Terms)

1. Scope and contracting party

(1) These Terms apply to all course bookings made via the website scalp-concept.com. The contracting party, organiser and payee is the association Scalp-Concept International - Akademie für manuelle Kopfschmerzbehandlung und Selbsthilfe (ZVR number 1936979788), Stegendorf 34, 9063 Maria Saal, Austria, phone +43 699 12786750, email office@scalp-concept.com (hereinafter the “association”).

(2) These Terms apply to consumers within the meaning of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG) as well as to businesses. Provisions that apply only to consumers are marked as such. Deviating terms of participants do not apply.

(3) Courses are held in rented seminar venues at changing locations; some formats are also offered online or in a hybrid format. The format, course venue, date(s), content, target group and price are set out in the respective course description on the website.

2. User account

(1) A free user account is required for booking. The details provided at registration must be truthful. Please keep your password secret.

(2) You can see your bookings in the member area; course materials may also be provided there.

(3) The user account does not constitute membership of the association. You can request deletion of your account by email at any time; statutory retention obligations remain unaffected (see Privacy Policy).

(4) The association may block a user account if it is misused.

3. Conclusion of the contract

(1) The course descriptions on the website do not yet constitute a binding offer by the association.

(2) How to book: you select a course, log in or register, check the overview “Your booking at a glance” (provider, course, date, venue and total price), confirm by ticking the box that you have read and accept these Terms and the withdrawal information, and click “Book and pay” (for free courses “Register (binding)”). In doing so you submit a binding offer to conclude the course contract. Before this click you can check your details at any time and cancel the process; you can also still cancel the payment on Mollie's payment page. If the course starts less than 14 days after booking, you can additionally and voluntarily request that we begin the service before the end of the withdrawal period (see withdrawal information).

(3) For courses subject to a fee, you are then redirected to Mollie for payment. The contract is concluded as soon as the payment has been completed successfully; the booking is then confirmed to you on the website and shown in your member area. For free courses, the contract is concluded when the registration is confirmed on the website. In addition, you receive a booking confirmation by email with your booking number, the contract details, these Terms, the withdrawal information and the model withdrawal form.

(4) The language of the contract is German. The English translation of the website and of these Terms is for information only; the German version is legally binding. Your booking data are stored by the association and can be accessed by you in the member area. You can access, print or save these Terms on this page at any time.

4. Prices and payment

(1) All prices are total prices in euros including any applicable VAT. The services included in the course price are set out in the course description. Travel and accommodation costs are not included.

(2) The course price is due upon booking. Payment is made via the payment service provider Mollie B.V., Keizersgracht 126, 1015 CW Amsterdam, the Netherlands, using the payment methods stated in the booking overview, which are also shown to you on Mollie's payment page. The payee is the association.

(3) Refunds are made using the same means of payment you used for the booking, unless expressly agreed otherwise.

5. Running of the course and changes

(1) Minor, objectively justified changes to the course schedule or content, as well as a change of course instructor (e.g. due to illness), are permitted provided that the overall character of the course is preserved and the change is reasonable for you.

(2) If the date, the venue or the format (in person, online or hybrid) has to be changed significantly, the association will inform you without delay. You may then withdraw from the contract free of charge and will receive a full refund of any payments already made.

(3) During practical exercises, please follow the instructions of the course instructor and inform them before the course begins of any health restrictions that would speak against being treated during the practical exercises.

(4) Audio, photo and video recordings during the course are only permitted with the consent of the course instructor and of the persons concerned.

6. Cancellation by participants

(1) You may cancel the course contract up until the start of the course. Please give notice of cancellation in writing; an email to office@scalp-concept.com is sufficient, and you can also use the “Withdraw from contract” function. The decisive date is the day on which your notice of cancellation is received by the association; the periods are calculated from the first day of the course. The following cancellation terms apply:

  • Cancellation up to 30 days before the start of the course: free of charge, you receive a full refund of the course price
  • Cancellation 29 to 14 days before the start of the course: cancellation fee of 50% of the course price
  • Cancellation from 13 days before the start of the course and non-attendance: cancellation fee of 100% of the course price

(2) You may name a substitute to attend in your place free of charge at any time. Please send us their name and email address before the course begins.

(3) For consumers: the statutory right of withdrawal (see withdrawal information below) remains unaffected. Within the withdrawal period of 14 days from the conclusion of the contract, you may withdraw from the contract without a cancellation fee in accordance with the withdrawal information.

7. Cancellation by the association

(1) The association may cancel a course for good cause, in particular if there are too few registrations, if the course instructor is unavailable (e.g. due to illness) and no equivalent replacement is possible, or due to force majeure. You will be informed of this without delay.

(2) If the association cancels a course, you receive a full refund of all payments already made. Further claims, for example for reimbursement of travel or accommodation costs, do not exist unless the association caused the cancellation intentionally or through gross negligence.

8. Certificate of attendance

After full attendance you receive a certificate of attendance. Whether and under what conditions a certificate is also issued is set out in the course description. Certificates of attendance and certificates issued by the association are not state-recognised qualifications and do not entitle the holder to practise a health profession. The techniques learned may only be applied to patients within the scope of one's own professional authorisation.

9. No promise of cure, liability

(1) The courses teach knowledge and techniques of the Scalp-Concept® method. No particular treatment or healing outcome is promised. The courses, including self-care workshops for people with headaches, do not replace a medical diagnosis or treatment. If you have persistent, new or unusually severe headaches, please consult a doctor.

(2) The association is not liable for slight negligence. This does not apply to personal injury.

10. Copyright in course materials

Course materials (printed or digital, including in the member area) are protected by copyright. They may only be used for your personal purposes as part of your training and continuing education. Reproduction, distribution, publication or use for your own courses is not permitted without the association's prior written consent.

11. Data protection

Information on the processing of your personal data can be found in our Privacy Policy.

12. Applicable law, place of jurisdiction and dispute resolution

(1) Austrian law applies, excluding the conflict-of-law rules of private international law. For consumers, this choice of law only applies insofar as it does not deprive them of the protection afforded by the mandatory provisions of the law of the state in which they have their habitual residence.

(2) For actions against consumers who have their domicile, habitual residence or place of employment in Austria, only a court in whose district one of these places is located has jurisdiction (§ 14 KSchG). For businesses, the court with subject-matter jurisdiction for the association's registered office has exclusive jurisdiction.

(3) The association is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

(4) Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.

Withdrawal information

Consumers have the following right of withdrawal for course bookings made via this website.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period will expire after fourteen days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (Scalp-Concept International - Akademie für manuelle Kopfschmerzbehandlung und Selbsthilfe, Stegendorf 34, 9063 Maria Saal, Austria, phone +43 699 12786750, email office@scalp-concept.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

You can also exercise your right of withdrawal online at scalp-concept.com/en/withdrawal (link “Withdraw from contract” at the bottom of every page). If you use this online function, we will communicate to you an acknowledgement of receipt of such a withdrawal on a durable medium (e.g. by email) without delay, with information on the content of the notice of withdrawal and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.

Early start and expiry of the right of withdrawal

If a course starts before the end of the withdrawal period, you can voluntarily and expressly request at the time of booking that we begin the service before the end of the withdrawal period. Your right of withdrawal then continues to exist until the service has been fully performed; in the event of withdrawal, however, you pay the proportionate amount described above for the services provided up to that point.

The right of withdrawal expires when we have fully performed the service after you expressly requested that we begin the service before the end of the withdrawal period and confirmed that you are aware that you lose your right of withdrawal once the contract has been fully performed.

If you did not make such a request, you can still attend the course as booked.

Cancellation after the withdrawal period

After the withdrawal period has expired, the cancellation terms in section 6 of the Terms apply to a cancellation.
